Construction Group. Mr. Reichstein has been called upon to draft and
prosecute construction claims, negotiate, and when necessary, litigate on behalf
of construction clients.
Representative construction projects have included: Chicago O'Hare International
Airport; Ronald Reagan National Airport; Chicago Federal Building; Art Institute
of Chicago; Chicago Sugar House Post Office; Alaska Elmendorf Air Force Base;
South Carolina Camp Lejeune; public and private building, heavy construction and
utility projects.
Litigation
assignments include construction claims brought in federal court which resulted
in successful, high dollar value jury verdicts in favor of the contractor.
Government
Contracts. Represented a sub-contractor in federal district court who
was adversely affected by Congressional termination of the McDonnell Douglas
Aircraft A-12 tactical fighter program. The matter included an analysis of the
flow down provisions of the General Electric Company jet aircraft engine
division. The work effort involved preparation of a claim for equitable
adjustment and the resultant commercial litigation in the Federal District Court
for the Northern District of Illinois.
Retained by a
company manufacturing fire fighting equipment for on ship-board use by the U.S.
Navy. Performed schedule delay and cost analysis on a claim to equitably adjust
the contract price and delivery schedule. The contractor's claim contemplated
both express and constructive changes. The claim package included a discussion
section with individual cost recovery computations for such elements as analysis
of unabsorbed overhead expense, escalation and cost of capital.
Assisted a
prime contractor in a Department of Defense contract in support of Operation
Desert Storm. The early and successful conclusion of that military action led
to a series of federal terminations for convenience contract actions. The work
included application of legal principles to loss of learning curve, productivity
analysis, causes of changes, delay and disruption cost recovery.
Represented a
federal contractor before the General Accounting Office in a bid protest action
resulting in cancellation of the planned acquisition and resolicitation with a
corrected and unbiased format. The work was particularly noteworthy in view of
the relatively poor outcomes commonly associated with contractor actions before
the GAO.
Retained by a
company manufacturing a component based on drawings and specifications furnished
by the U.S. Navy for a flight component on the Navy A-6 fighter airplane. The
work encountered various out of scope effort caused by deficiencies in the
government's blue prints. Legal representation included analysis of the contract
performance and preparation of a Claim for Equitable Adjustment of the contract
price.
Trademark
Infringement. Retained to initiate commercial litigation in defense of
trademark infringement by a competitor. Work involved analysis of contract
language to ascertain rights in technical data and conveyances in international
trade markets, and prosecution of the client's claim in federal court.
Qui tam
litigation. Initiated a lawsuit in federal court concerning allegations of
fraud within the Medicare and Medicaid programs. The matter involved a detailed
analysis of the federal regulations for invoicing and claims preparation as well
as a selected treatment of issues of allocability and computation of overhead
pools.
Commercial
transactions. Represented the buyers in a corporate acquisition. The work
included structuring the capital for the new firm, negotiation on behalf of the
buyers and preparation of all transactional documents.
Selected
Lectures. Guest speaker before the National Contract Management
Association, the Environmental Protection Agency, the Small Business
Administration, Small Business Innovative Research Center. Lecture topics
include intellectual property, federal and private commercial law, contract
formation and defenses, contract clauses and formation of government contracts,
rights and remedies under innovative research contracts.
